Independent Contractor & No Agency Relationship

All Trusted Partners listed, introduced, or referenced by 305Senior are independent businesses or professionals — not employees, agents, representatives, or affiliates of 305Senior. Nothing within the 305Senior platform or relationship structure shall be interpreted as creating an employment relationship, an agency relationship, a joint venture or partnership, or any authority for a partner to act on behalf of 305Senior.

No Responsibility for Services

305Senior acts solely as a connector and referral resource. 305Senior does not provide, supervise, direct, or control any services offered by Trusted Partners. 305Senior does not guarantee the quality, outcomes, or results of any services. All services are performed solely under the responsibility of the Partner and their direct agreement with the client.

Clients engage Trusted Partners at their own discretion and risk.

No Endorsement or Guarantee

While 305Senior implements a vetting process to evaluate potential partners, inclusion in the network does not constitute a guarantee of service quality, does not represent certification, licensing authority, or endorsement, and does not assure future performance or client satisfaction. 305Senior makes no warranties, express or implied, regarding accuracy of partner information, availability of services, or suitability of partners for any specific need.

Membership Fee Disclosure

Any fees paid to 305Senior by Trusted Partners, including the $480 annual membership, are fees for marketing, visibility, and network participation. They are not payments for referrals, leads, or client placements and are not contingent upon any business generated or services performed. 305Senior does not sell referrals, patient leads, or client transactions.

All referrals are made based on client needs, professional fit, availability, and relationship-based discretion.

No Fee Splitting / Anti-Kickback Compliance

305Senior does not engage in fee-splitting arrangements, commission-based referral structures, or compensation tied to specific client outcomes or transactions. All financial arrangements are structured to comply with applicable federal and state laws, anti-kickback regulations (where applicable), and professional licensing requirements.

Partners are solely responsible for ensuring compliance within their regulated industry.

Client Relationship Disclaimer

All service relationships exist exclusively between the client and the Trusted Partner. 305Senior is not a party to service agreements, contracts, billing arrangements, or dispute resolution processes. Any issues regarding services must be addressed directly between the client and the Partner.

Limitation of Liability

To the fullest extent permitted by law, 305Senior shall not be liable for any services provided by Trusted Partners, errors, omissions, or negligence by partners, client dissatisfaction or outcomes, or financial losses or damages. This includes, but is not limited to, direct damages, indirect damages, or incidental or consequential damages.
